1.1 "Platform" includes the khypri.com domain, sub-domains, mobile applications, APIs, and the underlying computational engine.

1.2 "AI Output" refers to any text, code, image, or pedagogical structure generated by the Company's proprietary Large Language Model (LLM) orchestration layer.

1.3 "User Content" refers to any prompts, data, or curriculum uploads provided by the User to the Platform.

2.1 Legal Capacity

You represent that you have the legal authority to enter into this Agreement. If acting on behalf of a minor, you affirm that you are the biological parent or court-appointed legal guardian.

2.2 Verifiable Identity

You agree to provide authentic, verifiable information during onboarding. The use of pseudonyms intended to deceive or impersonate is grounds for immediate termination.

2.3 Credential Security

You bear absolute liability for all activities occurring under your credentials. The Company employs multi-factor geolocation tracking; any detected unauthorized cross-border or cross-household credential sharing will result in automatic account locking without refund.

3.1 No Academic Guarantee: Participation in Khypri modules does not guarantee success in competitive examinations. Reliance on AI Output for high-stakes assessment is strictly discouraged without secondary human verification.

3.2 Bias & Content: While we utilize robust safety filters, the probabilistic nature of AI means content may occasionally reflect unintentional biases. Users are required to report such instances immediately via support@khypri.com.

4.1 Personal Educational License: We grant you a limited, revocable, non-exclusive license to use the Platform for personal learning. This license is restricted to a *single household*.

4.2 Commercial Prohibition: Use of Khypri Content in commercial coaching centers, schools, or for-profit tutoring without a "Corporate Enterprise Agreement" is a breach of contract subject to liquidated damages.

4.3 Derivative Works: You may not modify, publish, transmit, or participate in the transfer or sale of any AI Output for the purpose of creating competing educational products.

The following actions result in immediate, non-appealable termination:

• Model Extraction: Any attempt to reverse-engineer the "System Prompts" or underlying weights of the Khypri AI engine.
• Prompt Injection: Using the Platform to generate malware, hate speech, or sexually explicit material via adversarial prompting.
• Automated Extraction: The use of headless browsers, scrapers, or CURL commands to download Khypri question banks.
• AI Training: Using Khypri outputs to train or evaluate other machine learning models or competing EdTech platforms.

6.1 Company IP: All code, mascot designs, logic flows, and "AI Personalities" are the sole property of khypri.com.

6.2 Feedback License: If you provide suggestions or feedback, you grant us an irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation.

6.3 Copyright Enforcement: We employ digital watermarking on all AI-generated practice papers. Unauthorized distribution will be tracked and prosecuted under the Indian Copyright Act (1957).

7.1 Subscription Terms: All subscriptions are billed in advance. You authorize the Company to charge your provided payment method for recurring cycles until cancellation.

7.2 Price Adjustments: We reserve the right to adjust pricing with 30 days' notice. Continued use after the price change constitutes acceptance of the new rates.

7.3 Taxes: You are responsible for all applicable taxes (GST, etc.) associated with your purchase.

9.1 No Consequential Damages: The Company shall not be liable for any indirect, incidental, or consequential damages, including loss of data or academic standing.

9.2 Liability Cap:

To the maximum extent permitted by law, the Company's total liability for any claim shall not exceed the total amount paid by the User to the Company in the last 3 months preceding the incident.

You agree to indemnify, defend, and hold harmless khypri.com and its officers from and against any claims, liabilities, or expenses (including legal fees) arising from your breach of this Agreement, your User Content, or your minor child's use of the Platform in violation of these terms.

11.1 Data Fiduciary: We operate in strict accordance with the Digital Personal Data Protection Act (2023) of India.

11.2 Minor Data: We do not engage in behavioral monitoring of minors for advertising. We collect only the data points required for pedagogical progression.

11.3 AI Privacy: We do NOT use specific student inputs to train our general-purpose base models, ensuring that your child’s creative work is never leaked into the public AI domain.

12.1 Beta Features: Features marked as "Beta" or "Experimental" are provided with zero service-level guarantees and may be withdrawn at any time.

12.2 Force Majeure: Neither party shall be liable for any failure to perform due to causes beyond their reasonable control, including acts of God, war, strikes, or catastrophic failure of the global internet backbone or LLM providers (e.g., Google, OpenAI).

This Agreement shall be governed by the laws of India. Any legal action shall be brought exclusively in the courts of Bengaluru, Karnataka, India.

14.1 Arbitration: Any dispute shall first be attempted to be resolved via mediation. If unsuccessful, it shall be settled via binding arbitration in Bengaluru under the Arbitration and Conciliation Act (1996).

14.2 Waiver of Class Action: You agree that any proceeding shall be conducted in your individual capacity only and not as a class action or other representative action.

15.1 Severability: If any provision is found unenforceable, the remainder of the Agreement remains in full force.

15.2 No Waiver: Failure to enforce a provision does not constitute a waiver of the right to do so later.

15.3 Entire Agreement: This constitutes the final and entire agreement between the parties regarding the Platform.
